Rental Agreement

This Equipment Rental Agreement (“Lease”) outlines the terms and conditions which users (“Lessee”) may rent equipment(“Equipment”) from JustRentLah LLP (“Lessor”), both online through www.justrentlah.com (Webshop) or offline through various methods, including but not limited to calls, texts, social media.

1. Acceptance of Lease
For online Webshop orders, this Lease becomes effective when Lessee clicks the “I have read and accept the rental agreement” and “complete checkout” buttons on the Webshop. For offline orders, Lessee acknowledges acceptance when either partial or full payment is made, or when Lessee or an appointed proxy signs the lease. Lessee agrees to be bound by this Lease and all the terms and conditions herein, regardless of whether they have been read.

2. Disclaimer
Lessor reserves the right to gather information from third parties regarding Lessee's past rental history and creditworthiness. Lessor reserves the right to refuse or cancel orders. By accepting this Lease, Lessee grants permission for the Lessor to contact them via call, text, or email regarding rental-related information. Lessor may make amendments to this Lease as necessary.

3. Order Acceptance Policy
Lessor reserves the right to accept, decline, or provide fewer quantities of items ordered by Lessee for any reason, at any time after receiving the order. Lessee will be informed of significant changes to an order.

4. Lease
Lessor leases the following equipment to Lessee, subject to possible amendments by Lessor.

5. Payment
Rent, deposit and shipping charges, must be paid in advance, in full.

6. Security Deposits
Security deposits less any appropriate deductions will be refunded within the following timeframe following the end of a Lease.

  • Webshop orders (Stripe / PayPal): 5 - 10 days
  • Offline orders (PayNow / PayLah / Cash): 1 - 3 days

7. Rental Period
The rental period begins on the specified rent start date / time (“Rent Start”) and expires on the rent end date / time (“Rent End”) listed in the invoice. Equipment must be returned to the Lessor before the rental period expires. Lessor reserves the right to charge Lessee additional rent for the extra time that the Equipment was in transit or late. 

8. Out of Stock Products
Any estimate of equipment availability by Lessor is based on the assumption that each of Lessor’s Equipment is returned on time within the stated rental period. Lessor will notify Lessee if any Equipment becomes unavailable and will make reasonable efforts to provide substitutes unless Lessee prefers to cancel part or all of the order.

9. Cancellations Charges and Change of Dates
Order cancellations will incur penalties as specified, excluding refundable deposits if any. Orders that include *special order items are non refundable.

  • Less than 24 hours notice: 100% of total rental fees 
  • Less than 72 hours notice: 50% of total rental fees
  • More than 72 hours notice: 15% of total rental fees
  • *Special order items include subrentals, custom equipment, services etc.

Lessee may request for a one time change of rental date(s), within 90 days of the canceled Rent Start date, no refunds or credits will be provided thereafter.

10. Early Returns
No refunds, discounts, or allowances will be provided for early returns or unused Equipment.

11. Late Returns
Failure to extend the Lease before expiration will result in automatic Lease extension and additional charges. If Lessee’s order is not available for extension due to conflicting order(s), Lessor shall inform the Lessee and if the Equipment is not returned on time, charge Lessee the rental fee of a new order commencing on the initial Lease’s Rent End.  

  • If Equipment is not returned within 3 days after the Rent End and Lessor is unable to collect rent, the Equipment will be considered stolen and Lessee will be charged the full replacement value.
  • If Equipment is not returned within 7 days after the Rent End and Lessor is unable to collect rent or the replacement value. The Lessee shall be considered to be in default

12. Delivery and Pick Up Service (Shipping Charges)
Lessee is responsible for both outbound ("Delivery") and return ("Pick Up") shipping charges unless otherwise agreed. Timings provided by Lessor are estimates; exceeding them does not warrant Lease cancellation unless due to Lessor's gross negligence. Lessee will incur additional charges for failed attempts due to inability to accept or return the Equipment.

13. Insurance
Lessor does not provide insurance for leased Equipment. Lessee may choose to insure the equipment and must add Lessor as an additional insured, providing a Certificate of Insurance upon request.

14. Repairs
Lessee must not attempt to repair or materially alter leased Equipment

15. Damaged or Modified Equipment
Lessee shall keep the Equipment in good working order without material modifications

  • In the event of any material modifications, Lessee will be responsible for reasonable restoration costs.
  • Lessee assumes and bears the risk of damage to Equipment from any cause, including damage in transit with a non Lessor appointed shipper.
  • Any damage not reported within 24 hours is considered to have occurred during the Lease.
  • In the event of damage, repair and replacement charges will be assessed based on commercial reasonableness.
  • For disputes as to whether damage occurred during Lessee's possession the Equipment shall be sent to an external repair facility. The opinion of the repair facility as to the cause of the damage, shall be binding
  • A cleaning fee may be charged for removing substances (e.g, powder, dirt, sand, mud) from Equipment upon return  
  • An inconvenience fee, ranging from 1 to 7 days' rental rate, will be charged for any unreported damages or missing critical equipment during the lease period. This fee is separate from any repair or replacement charges.

16. Loss of Equipment
Lessee assumes the risk of Equipment loss during the Lease. Lost or stolen Equipment must be reported within 24 hours. Failure to pay for lost or stolen Equipment may result in default. Lessee will be charged additional rent until the Equipment is returned or replaced.

17. Non Working Equipment
Lessee must report equipment malfunctions or damage within 24 hours. Failure to do so implies that the Equipment is in good working order. Non-working equipment will be replaced or refunded as appropriate by Lessor. Damage suspected to be caused by Lessee will be assessed by a professional repair (“Professional Repair”) service. Lessee and Lessor hereby agree to be bound by the damage report provided by such Professional Repair as to the cause, liability and cost of repair of such damage.

18. Surrender
Upon Lease expiration or termination, Lessee must return Equipment in good working condition, except for normal wear and tear. Lessor’s acceptance of Equipment shall not represent Lessor’s determination as to the condition of the returned Equipment. Lessor may inspect the Equipment within a reasonable time after return to determine if the Equipment was damaged during the Lease. Lessee is responsible for removing personal items and digital media. Lessor is not liable for returning Lessee's property

19. Indemnity
Lessee indemnifies Lessor against any claims, damages, or liabilities arising from Equipment use.

20. Default
In default, all Lessee's owed amounts become immediately due. Lessor may:
Charge Lessee for all outstanding amounts, including late fees at 10% annual interest.
Use debt collectors to recover rents and other payments.
Take possession of the Equipment, without notice, wherever it is.
​Pursue legal or equitable remedies.

21. Ownership
Equipment is solely owned by the Lessor throughout the Lease.

22. Additional Documents
If requested by Lessor, Lessee must provide any necessary documents for verification and recording.

23. Warranty of Authority
Lessee warrants that anyone accepting Equipment on their behalf is authorized to do so. Lessor has no liability for verifying such authority.

24. Data Storage
Lessee acknowledges that any storage medium provided by the Lessor, whether external or built-in, is not liable for data loss or failure to save.

25. Age
By entering into this agreement, Lessee confirms they are at least 18 years old. If under 18, Lessee must have parental or guardian authorization.
